Top Tier Terms & Conditions

1. Introduction / Acceptance of Terms

Welcome to Top Tier, a videogame ranking application available at toptier-app.com. By accessing or using our services, including the website, mobile applications, and any related features (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

Top Tier reserves the right to modify these Terms at any time. Material changes will be communicated before they take effect. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Eligibility

You are responsible for any data or connectivity charges incurred when accessing the Service through mobile networks or internet service providers.

User Interactions

Top Tier provides features that allow users to interact, including viewing rankings, following other users, and discovering affinity scores. You are solely responsible for your interactions with other users. Top Tier does not conduct background checks on users and makes no guarantees regarding the conduct of any user.

No Commercial Advertising

You may not use the Service to distribute unsolicited advertising, promotional materials, or spam to other users.

User Conduct

You agree to use the Service in a lawful and respectful manner. You must not harass, intimidate, threaten, or engage in abusive behavior toward other users. You must not impersonate any person or entity, or misrepresent your affiliation with any person or entity.

Reporting

If you encounter content or behavior that violates these Terms, you may report it through the Service or by contacting info@japp-calisthenics.com. Top Tier will review reports and take appropriate action at its discretion.

Enforcement

Top Tier reserves the right to investigate and take appropriate action against anyone who, at its sole discretion, violates these Terms. Actions may include issuing warnings, suspending or terminating accounts, removing content, and reporting violations to law enforcement authorities.

4. User Content

You retain ownership of the content you create and submit through the Service, including game rankings, profile information, and uploaded photographs ("User Content"). You are solely responsible for your User Content and the consequences of sharing it.

You represent and warrant that you own or have the necessary rights to use and share your User Content, and that your User Content does not infringe or violate the rights of any third party.

5. Content License to Top Tier

By submitting User Content to the Service, you grant Top Tier a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating, providing, and improving the Service.

This license continues for a commercially reasonable period after you remove or delete your User Content from the Service, except where the content has been shared with other users who have not deleted it, or where Top Tier is legally required to retain it.

6. Third-Party Intellectual Property

The Service may display content that belongs to third parties, including videogame titles, cover art, logos, and metadata sourced from providers such as IGDB / Twitch. All such third-party content remains the property of its respective owners.

Top Tier does not claim ownership of third-party intellectual property. The use of such content within the Service is solely for informational and identification purposes to enhance the user experience.

7. Communications

By creating an account, you consent to receive communications from Top Tier, including service-related announcements, updates, and administrative messages sent via email or through the Service.

You may opt out of non-essential communications by adjusting your account settings or contacting info@japp-calisthenics.com. However, you may not opt out of essential service-related communications necessary for the operation of your account.
